This case is currently calendared for trial at the Court's Winston-Salem, North Carolina trial session, which is scheduled to begin May 30, 2023. On May 1, 2023, respondent filed a Motion to Remand (index #12) therein asking the Court to remand a case to the Appeals Office where a supplemental hearing is necessary to rectify the abuse of discretion. However, respondent indicated that petitioner's views as to the granting of the Motion are unknown. On May 2, 2023, the Court served an Order to Show Cause on petitioner instructing her to on or before May 22, 2023, file a response with the Court and show cause in writing why respondent's Motion to Remand filed May 1, 2023, should not be granted. On May 16, 2023, petitioner called Chambers and informed the chamber's staff that she does not object to respondent's Motion. And that she will send in a letter to that effect. To date, the Court has not received any written communication from petitioner. As the Court has some questions for the parties we will set this case for hearing.
Upon du consideration it is hereby
ORDERED that respondent's Motion to Remand (index #12) is set for hearing on May 30, 2023, at the Winston Salem, North Carolina Trial Session of the Court scheduled to commence at 10:00a.m. (EST) in Room 847, at 251 North Main Street, Winston-Salem, NC 27101. All parties are expected to be present and heard.
This order constitutes official notice of hearing to the parties.
