MATTER OF TARA WATKINS, PETITIONER-RESPONDENT, v. WILLIE E. BAXTRON, JR., RESPONDENT-APPELLANT.


PRESENT:

Respondent-appellant having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on June 27, 2016,

Now, upon reading and filing the affidavit of Willie Baxtron, Jr., sworn to September 12, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the submission of a new motion that includes, among other things, an affidavit that describes all real estate owned by appellant, including whether a property is his primary residence or a rental property, and whether it is solely owned by appellant, and sets forth the value of and amount owing on each property, and the gross monthly income, if any, derived from each property.
