ORDER DISMISSING CASE WITH PREJUDICE


On August 5, 2003, the Court denied plaintiff's application to proceed in forma pauperis, without prejudice, and dismissed plaintiff's complaint, with leave to amend the complaint within thirty days. The Court granted plaintiff leave to amend his complaint to state (1) the grounds upon which federal court subject matter jurisdiction may lie, and (2) facts sufficient to state a viable claim. More than thirty days have passed, but plaintiff has not filed an amended complaint.

Accordingly, plaintiff's complaint is DISMISSED with prejudice. The clerk shall close the file.

IT IS SO ORDERED.
