DECISION & ORDER ON MOTION
Appeal from an order of the Supreme Court, Nassau County, dated June 9, 2021. Motion by the appellant for leave to appeal to this Court from the order and to stay enforcement of the order, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further, ORDERED that the branch of the motion which is to stay enforcement of the order is granted to the extent that enforcement of so much of the order as directed disclosure of the documents identified by Bates stamp numbers QPWB 000001-QPWB 000008, QPWB 000025- QPWB 000041, QPWB 000045-QPWB 000050, QPWB 000102- QPWB 000107, QPWB 000145-QPWB 000147, QPWB 000149- QPWB 000197, QPWB 000334- QPWB 000339, QPWB 000395, QPWB 000404-QPWB 000406, QPWB 000783- QPWB 000785, QPWB 000901- QPWB 000907, QPWB 004321- QPWB 004323, QPWB 004427- QPWB 004429, and QPWB 004441- QPWB 004475, is stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before September 9, 2021, and that branch of the motion is otherwise denied; and it is further, ORDERED that in the event the appeal is not perfected on or before September 9, 2021, the Court, on its own motion, may vacate the stay, without further notice, or the respondents may move to vacate the stay, on three days notice.
