In Re: The Board of Supervisors for the University of Louisiana System, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 655940. BEFORE: HIGGINBOTHAM, HOLDRIDGE, AND PENZATO, JJ.
WRIT GRANTED WITH ORDER. The trial court's November 16, 2017 ruling denying the Exception to Plaintiff's Petition for Damages and Alternately a Motion to Transfer Venue for Forum Non Conveniens filed by the defendant, The Board of Supervisors for the University of Louisiana System, is reversed. We find that La. R.S. 23:303(A) is more specifically directed to the matter at issues herein than the general provisions of La. R.S. 13:5104(A) and mandates that the proper venue is Lafayette Parish as the parish in which the alleged violation of the Louisiana Employment Discrimination Law occurred. La. R.S. 23:303(A); See Black v. St. Tammany Parish Hosp., 2008-2670 (La. 11/6/09), 25 So.3d 711, 717. The exception of the Motion to Transfer Venue filed by the defendant, the Board of Supervisors for the University of Louisiana System, is granted, and the case is remanded to the trial court, which is instructed to transfer the proceeding to the 15th Judicial District Court in Lafayette Parish.
