By order dated November 18, 2002, the en banc court set a briefing and argument schedule in this original action. That order also enjoined Secretary of State Reed from canvassing or certifying the results of the November 2002 election as to Referendum 53 pending further order of this court. Having now fully considered the briefing, and having heard argument,
IT IS HEREBY ORDERED:
(1) The petition for a writ of prohibition or mandamus is denied.
(2) The injunction imposed on Secretary of State Reed by the November 18 order is lifted.
(3) The intervenors-respondents' request for attorney fees is denied.
An opinion explaining the court's decision will be issued in due course.
