ORDER

In lieu of granting the application for leave to appeal, and without prejudice to the reassertion of any arguments either on appeal or in the trial court, we VACATE the trial court's order denying defendant's motion for summary disposition and REMAND for further proceedings. On remand, the trial court shall conduct a balancing-of-the-equities analysis under Bazzi v Sentinel Ins Co, 502 Mich. 390, 406; 919 N.W.2d 20 (2018), and Pioneer State Mut Ins Co v Wright, 331 Mich.App. 396, 411; 952 N.W.2d 586 (2020). We do not retain jurisdiction. This order has immediate effect. MCR 7.215(F)(2).
