Warren v. K Byte-Reptron Electronics

Supreme Court of Michigan
Jan 16, 2004
469 Mich. 995 (Mich. 2004)

Opinion

No. 124265.

January 16, 2004.

Summary Disposition.

No. 124265. In lieu of granting leave to appeal, the decision of the Worker's Compensation Appellate Commission is reversed, and the closed award of benefits by the magistrate is reinstated. MCR 7.302(G)(1). The commission's decision affirming the magistrate's award "with modification" de facto vacated the closed award and denied all benefits to plaintiff. Since defendants neither appealed nor cross-appealed the magistrate's decision, the commission was without jurisdiction to grant them additional relief beyond sustaining the closing of the award. MCL 418.859a and MCL 418.861a(5), (6), and (11). Court of Appeals No. 246985.
