ORDER


Before the Court is Plaintiff's Motion for Partial Summary Judgment against Defendant Larry Johnson ("Defendant") (filed June 4, 2004). After reviewing the pleadings in this case, this Court concludes that Defendant has failed to raise a genuine issue as to any material fact, and that judgment, as a matter of law, in favor of Plaintiff is appropriate. FED. R. CIV. P. 56(e). Plaintiff's Motion, therefore, is hereby GRANTED for the reasons stated therein. Accordingly, Defendant is hereby ordered to turnover to the Receiver the amount of $1,573,790.50 within ten (10) days of the entry of the judgment.

It is so ORDERED.
