Ward v. McNeil

Supreme Court of Florida
Jan 14, 2011
Case No. SC10-1992 (Fla. Jan. 14, 2011)

Opinion

Case No. SC10-1992.

January 14, 2011.

Lower Tribunal No(s). 93-12523CF.

The petition for writ of habeas corpus is hereby denied. To the extent the petition alleges the petitioner is entitled to immediate release, the petition is denied as successive. See Jenkins v. Wainwright, 322 So. 477, 478 (Fla. 1975) (declaring that once a petitioner seeks relief in a particular court by means of a petition for extraordinary writ, he has picked his forum and is not entitled to a second or third opportunity for the same relief by the same writ in a different court). To the extent the petition seeks other relief, it is denied without prejudice to the petitioner seeking relief in an appropriate court below.

PARIENTE, LEWIS, QUINCE, POLSTON, and PERRY, JJ., concur.
