MEMORANDUM AND ORDER


By Order dated May 5, 1999, I dismissed plaintiff's complaint because it was frivolous. The Order did not specifically dispose of (1) a motion by plaintiff, filed May 4, 1999 "For Appointment of Magistrate Judge. Motion for Mistrial," or (2) a motion by plaintiff to amend the complaint. After the dismissal order was entered on May 5, 1999, plaintiff, on May 6, 1999 filed a Motion for Reconsideration of the Dismissal. Another defendant, Frank Rizzo, Jr., filed a Motion to Dismiss the Complaint, on May 26, 1999.

Plaintiff is suing eight defendants, including "Infiniti" (not otherwise identified), James Marsh, Esquire, Frank Rizzo, Jr. (apparently a member of the Philadelphia City Council), the "Catholic Church in America," the "Nation of Islam," Pennsylvania Governor Thomas W. Ridge, the United States of America, and Rick Opiela. The numerous papers filed by the plaintiff are utterly incomprehensible, both because plaintiff's handwriting is illegible, and because, to the extent they are legible, they make no sense at all. The complaint was therefore properly dismissed as legally frivolous. The pending motion of defendant Rizzo to dismiss the complaint will be dismissed as moot.

ORDER

AND NOW, this ___ day of June, 1999, IT IS ORDERED:

1. Plaintiff's Motion for Reconsideration is DENIED.

2. The Motion to Dismiss of defendant Frank Rizzo, Jr., is DISMISSED AS MOOT, plaintiff's complaint having been dismissed as frivolous by this Court's Order of May 5, 1999.
