JUDGMENT


Based on the parties' stipulation of October 8, 2003, this case is dismissed with prejudice. Judgment is hereby entered in favor of defendants, the San Mateo County Sheriff's Office and officers John W. Munsey, Laurance I. Gaines, and Albert D. Elzey, Jr., and against plaintiff Bernard K. Walls. Each side is to bear its own attorney's fees and costs.

IT IS SO ORDERED.

STIPULATION OF DISMISSAL PURSUANT TO F.R.C.P. 41(a)(2) AND (PROPOSED) ORDER THEREON

IT IS HEREBY STIPULATED by and between the parties to this action, through their designated counsel, that the above — captioned action be and hereby is DISMISSED WITH PREJUDICE pursuant to FRCP 41(a)(2) Each party to bear their own costs and attorneys' fees. Counsel for Plaintiff represents he has authority from Plaintiff to enter into this Stipulation.

Based upon the foregoing Stipulation for Dismissal pursuant to F.R.C.P. 41(a)(2), and good cause appearing, IT IS SO ORDERED THAT THIS CASE IS DISMISSED WITH PREJUDICE WITH EACH PARTY TO BEAR ITS OWN COSTS AND ATTORNEY'S FEES.
