ORDER

This 24th day of January 2012, it appears to the Court that:

(1) On November 2, 2011, the Clerk issued a notice directing that the appellant, Alexander Wall, show cause why this appeal should not be dismissed for Wall's failure to file the opening brief and appendix. On November 8, 2011, Wall filed a response to the notice to show cause.

(2) In his response to the notice to show cause, Wall requested an extension of time until January 10, 2012 to file the opening brief and appendix. By Order dated November 10, 2011, the Court granted Wall's request. The Court further ordered, however, that "[t]here shall be no further extensions," and that if Wall "fails to comply with this Order, the appeal will be dismissed without further notice."

(3) Wall has not filed the opening brief and appendix. For that reason, and in accordance with the November 10, 2011 Order, this appeal will be dismissed without further notice.

NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rule 29(b), that the appeal is DISMISSED.
