JUDGMENT


On January 22, 2002, the Recommendation of the United States Magistrate Judge was filed and notice was served on the parties pursuant to 28 U.S.C. § 636. No response has been received by the Court within the time limits prescribed by Section 636.

Therefore, the Court need not make a de novo review. The Court has reviewed the Recommendation of the United States Magistrate Judge and hereby adopts it.

IT IS THEREFORE ORDERED AND ADJUDGED that plaintiff's motion for partial summary judgment (docket no. 25) is denied, that defendants' motion for summary judgment (docket no. 29) is granted, and that this action be, and the same hereby is dismissed.
