ORDER OF DISMISSAL


Petitioner is proceeding pro se in this 28 U.S.C. § 2255 action. This matter comes before the court upon the Report and Recommendation of the Hon. John L. Weinberg, United States Magistrate Judge, to dismiss this action summarily without prejudice. Having reviewed that Report and Recommendation and any objections or responses to that, and the remaining record, the court finds and ORDERS as follows:

(1) The court adopts the Report and Recommendation. This action is hereby DISMISSED without prejudice.

(2) The Clerk shall close this case and enter judgment, and shall send a copy of this Order to petitioner and to Judge Weinberg.
