BRIAN WALKER, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 268th District Court Fort Bend County, Texas Trial Court Cause Nos. 20-DCR-093838 & 20-DCR-093839

Panel Consists of Chief Justice Christopher and Justices Zimmerer and Poissant.

ORDER

PER CURIAM

Appellant is represented on appeal by appointed counsel, Daniel Lazarine. Appellant's brief was originally due October 26, 2023. We granted three extensions of time to file appellant's brief in both appeals until January 26, 2024. When we granted the most recent extension, we noted that no further extensions would be granted absent exceptional circumstances. No brief was filed. On January 24, 2024 and January 31, 2024, counsel filed further requests for extensions of time to file appellant's brief. Although the motions indicated there was a need to supplement the reporter's record, the court reporter filed a supplemental reporter's record on February 13, 2024. As near as can be determined, the record has been fully supplemented as needed by appellant's counsel. To date, counsel has submitted no brief. We deny the requests and issue the following order.

Accordingly, we order Daniel Lazarine to file a brief with the clerk of this court on or before April 1, 2024. If Daniel Lazarine does not timely file the brief as ordered, the court may issue an order requiring appointment of new counsel.
