Opinion

CASE NO.: 2D19-1833

06-06-2019

Ivory Jamal Akeem WALKER, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

BY ORDER OF THE COURT:

As it appears that the trial court has not rendered a written order, we dismiss this petition for writ of certiorari without prejudice to petitioner refiling his petition after seeking relief on a motion in the trial court and obtaining a written adverse ruling. See Holt v. State, 250 So. 3d 206, 209 (Fla. 2d DCA 2018) (dismissing petition for writ of certiorari where petitioner sought review of trial court's oral order which did not vest jurisdiction in this court); see also Fla. R. App. P. 9100(c)(1) (petition for writ of certiorari must be filed within thirty days of rendition; 9.020(h) (defining "rendition" as "when a signed written order is filed with the clerk of the lower tribunal).
