MEMORANDUM OPINION ORDER


The Court is in receipt of defendant's letter dated February 12, 2003, requesting that the above-captioned case be transferred to the White Plains courthouse. For the reasons stated below, defendant's unopposed request is hereby GRANTED.

Rule 21(a) of the Rules for the Division of Business Among District Court Judges for the Southern District of New York provides that:

A civil case shall be designated for assignment to White Plains if:

(i) The claim arose in whole or in major part in the Counties of Dutchess, Orange, Putnam, Rockland, Sullivan and Westchester (the "Northern Counties") and at least one of the parties resides in the Northern Counties.

This case arises out of an allegation of employment discrimination at Regeneron's facility at 777 Old Saw Mill River Road, New York, which is located in Westchester County. Both plaintiff and defendant reside in Westchester County. In these circumstances, a designation to the White Plains courthouse is mandated by the rule.

Pursuant to Rule 22 of the Rules for the Division of Business, and in the interest of justice and sound judicial administration, the Court hereby reassigns this case to White Plains.

The Clerk of the Court is directed to transfer the above-captioned case to the White Plains division.

SO ORDERED.
