On May 24, 2024, correspondence from or on behalf of petitioner was filed as an imperfect petition to commence the above-docketed case. By Order served May 28, 2024, the Court directed petitioner to file an Amended Petition for consideration. No response to the Court's Order was received. By Order of Dismissal for Lack of Jurisdiction entered July 18, 2024, this case was dismissed for petitioner's failure to file an Amended Petition as directed by the Court. Thereafter, on July 25, 2024, the Court received from petitioner a First Amended Petition.

Upon due consideration, it is

ORDERED that the Court's Order of Dismissal for Lack of Jurisdiction, entered July 18, 2024, is hereby vacated and set aside. It is further

ORDERED that respondent shall move or answer with respect to the First Amended Petition in this case on or before September 24, 2024.
