Walker v. Belden Corporation

Supreme Court of Louisiana
Jul 1, 1976
334 So. 2d 216 (La. 1976)

Opinion

No. 58127.

July 1, 1976.

In re: Gloria Walker applying for certiorari, or writ of review, to the Court of Appeal, Third Circuit, Parish of LaSalle.

Writ denied. On the facts found by the court of appeal, there is no error of law in the judgment complained of.

TATE, J., respectfully dissents. Although the majority characterizes the issue as factual, the findings of the trial court show disabling aggravation of a pre-existing condition, which evidence, in my opinion, was incorrectly construed as not proving an "accident".

DIXON, J., dissents from denial.
