No. 04-15-00683-CV

From the County Court At Law No. 10, Bexar County, Texas
Trial Court No. 2015CV03726
Honorable David J. Rodriguez, Judge Presiding
ORDER
Appellant's brief was originally due February 22, 2016. This court granted appellant three motions to extend time to file the brief and it is currently due April 4, 2016, giving appellant a total of forty-two days to file the brief from the original due date. In his third motion, appellant advised he would not file any additional motions. In reliance on the statement, appellee did not opposed the motion. However, appellant has now filed a fourth motion, asking for an additional eighteen days to file the brief. Appellee has opposed the motion based on appellant's prior statement that he would not file any additional requests for extension of time, but would dismiss his appeal if he could not file the brief by April 4, 2016. However, given the short lengths of time previously requested - and that granting this request would give appellant only a total of sixty days from the original due date, we GRANT appellant's fourth motion to extend time to file the brief and ORDER appellant to file his brief on or before April 22, 2016. We advise appellant that no further extensions of time to file the brief will be granted absent written proof of extraordinary circumstances.
