Dear Counsel:

On May 4, 2010, John G. Mulford, Esquire, filed a timely Motion for Summary Judgment in regard to this mortgage foreclosure case. The gist of the Motion is that Plaintiff is not required to accept partial payments and may accelerate the Defendant's obligations.

Defendant has chosen not to file any authority or other pleadings opposing the summary judgment motion.

Defendant was supposed to file by July 28, 2010. For some reason, there was no "follow-up" by this Court until late October when the Prothonotary's Office was informed by Mr. Gray's office that nothing would be forthcoming.

Therefore, Plaintiff's Motion for Summary Judgment is granted. Plaintiff should forward a form of order, including the appropriate sums due etc., to this Court, and copy it to Mr. Gray.

IT IS SO ORDERED.
