190th District Court of Harris County, No. 2022-83133
ORDER OF ABATEMENT
Veronica Rivas-Molloy, Judge
The parties filed a Joint Motion to Abate and Stay Appellate Deadlines [until May 1, 2024] to Facilitate Settlement, stating that "they are in the process of implementing an agreement to settle all of the claims in the underlying action[,]" . . . that "[c]entral to the settlement is the sale of nine real properties in six states with a closing date of April 30, 2024[,]" and that the parties are seeking to "abat[e] this appeal until that closing date passes, to avoid waiving their respective appellate rights."
We grant the parties' join motion. This appeal is therefore abated, treated as a closed case, and removed from the Court's active docket.
On or before May 1, 2024, the parties are ORDERED to file a motion to reinstate and dismiss the appeal, a motion to reinstate and proceed with the appeal, or a report advising the Court of the status of the proceedings. If the parties do not respond as directed, the case may be reinstated on the Court's active docket and the appeal will proceed under the applicable Texas Rules of Appellate Procedure.
It is so ORDERED.
