Opinion

Motion No: 2015-02394 KC

05-12-2017

Western Estates, LLC, Respondent, v. Ronsheeka N. Harte, Appellant.

THOMAS P. ALIOTTA

MARTIN M. SOLOMON, JJ.

DECISION & ORDER ON MOTION

On the court's own motion, it is

ORDERED that this appeal from an order of the Civil Court of the City of New York, Kings County, entered September 21, 2015, is stricken from the appeals calendar and the general calendar on the ground that the appeal has not been properly perfected.

An examination of the record indicates that the Civil Court, in determining the motion giving rise to the order appealed from, relied upon certain statements and admissions made at oral argument. In these circumstances, the minutes of oral argument are a necessary part of the record on appeal but have not been included therein.
