Viscioso v. Manz

District Court of Appeal of Florida, Third District
Apr 26, 2000
756 So. 2d 238 (Fla. Dist. Ct. App. 2000)

Opinion

No. 3D99-2082.

Opinion filed April 26, 2000.

An appeal from the Circuit Court of Monroe County, Thomas G. O'Connell, Judge, L.T. No. 97-10238.

Jeffrey A. Norkin and Jonathan M. Drucker, for appellant.

Josephs, Jack Gaebe and Scott A. Cole, for appellees.

Before GERSTEN, GODERICH and SHEVIN, JJ.

Affirmed. See Zeidwig v. Ward, 548 So.2d 209 (Fla. 1989) (where court determined that criminal defendant received effective assistance of counsel, defendant/attorney in subsequent civil malpractice action may defensively assert collateral estoppel); State v. Viscioso, 709 So.2d 650 (Fla.3d DCA 1998) (affirming on appeal and cross appeal order granting Rule 3.850 relief); Johnson v. Raban, 702 S.W.2d 134, 138 (Mo.Ct.App. E.D. 1985) (effective administration of justice would be undermined if prior decision on same issue is ignored).
