Elizabeth Viscaino, Appellant, v. The State of Texas, State.

Appeal from the County Court of Presidio County, Texas (TC# 5810) ORDER

On August 13, 2014, the Court ordered the trial court to conduct a hearing to determine if Appellant is entitled to the appointment of counsel on appeal. The trial court conducted the hearing and determined that Appellant is unable to pay for the reporter's record in the estimated amount of $2,300 but she is able to pay an attorney's fee in the estimated amount of $5,000 to $7,500 for representation on appeal. We have reviewed the record of the hearing and find that the evidence does not support the trial court's conclusion regarding Appellant's ability to pay an attorney's fee. Accordingly, we order the trial court to appoint counsel to represent Appellant in the direct appeal to this Court.

IT IS SO ORDERED this 22nd day of September, 2014.
