VIRTEX OPERATING CO., INC. and VirTex Producing Company, L.P., Appellants v. Robert Leon BAUERLE and Cynthia Bauerle, Appellees

From the 81st Judicial District Court, Frio County, Texas
Trial Court No. 12-10-00365-CVF
Honorable Donna S. Rayes, Judge Presiding

ORDER

The reporter's record was due October 3, 2016. On the due date, the court reporter filed a notification of late record seeking an additional sixty days to file the reporter's record, citing a busy workload as the reason for the extension. After review, we GRANT the requested extension in part and DENY it in part. Specifically, we GRANT the reporter an additional thirty days in which to file the reporter's record; we DENY his request for an additional sixty days in which to file the record. See Tex. R. App. P. 35.3(c) (stating appellate court may extend deadline to file appellate record, but each extension "must not exceed 30 days in an ordinary or restricted appeal . . . ."). Accordingly, we ORDER the court reporter to file the reporter's record in this court on or before November 2, 2016.

We order the clerk of this court to serve a copy of this order on all counsel and the court reporter.
