ORDER MODIFYING OPINION

THE COURT:

It is ordered that the opinion filed in this case on August 19, 2009, be modified as follows:

On page 15, delete from the second sentence of the second full paragraph (lines 20 and 21) the words, “file a writ petition and seek a stay of the proceeding, or to,” so that the sentence reads:

Her remedy was to wait until the judgment and then appeal if her client was convicted.

There is no change to the judgment.
