ORDER

This case is calendared for trial at the Tampa, Florida, trial session of the Court scheduled to commence on December 18, 2023.

On November 17, 2023, the Commissioner filed a Motion for Continuance. The Commissioner states that Ms. Vining has not been afforded a conference with his Appeals Office, but he believes that the case is susceptible to settlement once an Appeals Officer is assigned this case. The Commissioner further states that Ms. Vining does not object to the Court granting the Motion. Same day, the Commissioner filed an Entry of Appearance, at Doc. 10, without attaching a proper Certificate of Service.

The premises considered, Ms. Vining's assent to the Court granting the Motion, and for cause, it is

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on December 18, 2023. It is further

ORDERED that the Commissioner's Motion for Continuance, filed November 17, 2023, is granted, and this case is continued. It is further

ORDERED that the Commissioner's Entry of Appearance, at Doc. 10, is hereby stricken from the Court's record in this case. It is further

ORDERED that this case is returned to the general docket for trial or other disposition in due course.
