Judgment reversed and new trial granted, costs to abide the event.


We are of opinion that under the doctrine of Garby v. Bennett ( 40 App. Div. 163; affd., 166 N.Y. 392) the case presented a question for the jury. The judgment must be reversed and a new trial be granted, costs to abide the event.
