Appeal from the County Court at Law No. 4 of Williamson County, Texas (TC# 15-1477-CC4) ORDER
The Court has reviewed Appellee's motion to dismiss the appeal as moot due to issuance of the writ of possession. The Court has also reviewed Appellant's response to the motion and his brief on the merits to determine whether Appellant has raised a potentially meritorious claim of right to current, actual possession of the premises which would preclude dismissal of the appeal. The Court has determined that it will not rule on the motion to dismiss immediately, but will pass the motion and consider it when the case is submitted on the merits. Further, the Court GRANTS the Appellee's first motion for extension of time to file the brief until May 28, 2016. Because a motion to dismiss is pending, the Court will, on its own motion, expedite the appeal after Appellee's brief is filed.
IT IS SO ORDERED this 11th day of April, 2016.
PER CURIAM Before McClure, C.J., Rodriguez and Hughes, JJ.
