LUIS A. VILLANUEVA, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent
ORDER TO SHOW CAUSE
Courtney D. Jones, Judge
This case was called from the calendar of the Court's September 19, 2022, trial session for New York City, New York. There was no appearance by or on behalf of petitioner. Respondent appeared and was heard. Prior to calendar call, on August 25, 2022, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute is taken under advisement. It is further
ORDERED that, on or before October 19, 2022, petitioner shall show cause in writing why respondent's Motion to Dismiss for Failure to Properly Prosecute should not be granted and a decision entered in this case. Failure to respond to this order will likely result in the granting of respondent's motion and entry of decision against petitioner. It is further
ORDERED that the undersigned retains jurisdiction of this case.
