PARTIAL DISMISSAL


Plaintiff Rogelio Villanueva hereby requests dismissal without prejudice of his Fourth Cause of Action, California Civil Rights Violation: Cal. Civil Code § 52.1 and his Fifth Cause of Action under 42 U.S.C. § 1983. Plaintiff's First, Second and Third causes are remaining and are all brought under the California Fair Employment and Housing Act.

The 42 U.S.C. § 1983 claim was Plaintiff's only Federal cause of action. All parties are citizens of the State of California. Only causes of action under the California Fair Employment and Housing Act remain. Plaintiff requests that this case be remanded to the Superior Court of the City and County of San Francisco.

IT IS SO ORDERED.
