Villano v. G C Homes, Inc.

Court of Appeals of the State of New York
Nov 18, 1976
40 N.Y.2d 959 (N.Y. 1976)

Opinion

Submitted October 25, 1976

Decided November 18, 1976

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, ANTHONY J. CERRATO, J.

Ronald R. Coles for motion.

No one opposed.

Motion dismissed upon the ground that the order sought to be appealed from does not finally determine the action within the meaning of the Constitution. The order of Special Term denying a motion by plaintiffs to set damages at $1 does not render the order sought to be appealed from final.
