ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


After making an independent review of the pleadings, files and records in this case, and the Findings and Recommendation of the United States Magistrate Judge dated January 23,2003, the Court finds that the Findings and Recommendation of the Magistrate Judge are correct and they are accepted as the Findings and Recommendation of the Court.

IT IS, THEREFORE, ORDERED that the Findings and Recommendation of the United States Magistrate Judge are accepted.

SO ORDERED.

JUDGMENT

The Court has entered its Findings in the case, accepting the Findings and Recommendation of the Magistrate Judge. Therefore,

It is ORDERED, ADJUDGED and DECREED that petitioner's application for writ of habeas corpus is DENIED.

It is further ORDERED that the Clerk shall transmit to the parties a true copy of this Judgment, together with a true copy of the Order Accepting the Findings and Recommendation of the United States Magistrate Judge.
