ORDER

Daniel A. Guy, Jr. Special Trial Judge.

This case is set on the Court's remote trial calendar for Syracuse, New York, scheduled to be called on June 14, 2021. On June 8, 2021, the Court received an informal communication that petitioner is unable to proceed to trial at this time due to family health concerns. Although the Court will continue the case, petitioner should understand that this matter must be resolved in the coming months and he is obliged in the coming weeks to provide respondent with any documents that he intends to rely on to substantiate any deductions that he claims for the year in issue. Any documents that are not shared with respondent will not be admitted into evidence at trial, should one be necessary. If the parties are unable to settle this matter by early August 2021, the Court will set this case for trial in October 2021.

Upon due consideration and for cause, it is

ORDERED that, on the Court's own motion, this case is continued and is stricken from the Court's remote trial calendar for Syracuse, New York. It is further

ORDERED that on or before August 9, 2021, the parties shall file a stipulated decision or respondent shall file a status report with the Court informing the Court of the then present status of this case.

ORDERED that jurisdiction over this case is retained by the undersigned.
