This case is calendared for a remote trial at the session of the Court scheduled to commence on February 27, 2023, for cases in which Portland, Oregon, is the place of trial.

On February 1, 2023, respondent filed a motion for judgment on the pleadings (respondent's motion). On February 8, 2023, the Court issued an order directing petitioner and intervenor to each file on or before February 22, 2023, a response to respondent's motion. On February 9, 2023, the Court held a conference call with the parties. During that call, the parties discussed, among other things, respondent's intent to file a motion to withdraw respondent's motion, to which petitioner and intervenor did not object. On February 10, 2023, respondent filed a motion to withdraw seeking to withdraw respondent's motion filed February 1, 2023.

According, it is

ORDERED that respondent's motion to withdraw filed February 10, 2023, is granted and respondent's motion for judgment on the pleadings filed February 1, 2023, is deemed withdrawn. It is further

ORDERED that the Court's order issued February 8, 2023, directing petitioner and intervenor to each file a response on or before February 22, 2023, is hereby vacated.
