Order

By order of May 20, 2020, the application for leave to appeal the January 23, 2018 judgment of the Court of Appeals was held in abeyance pending the decisions in Pearce v. Eaton Co Rd Comm'n (Docket No. 158069) and Brugger v. Midland Co. Bd. of Rd. Comm'rs (Docket No. 158304). On order of the Court, the cases having been decided on June 4, 2021, ––– Mich ––––, ––– N.W.2d ––––, 2021 WL 2290772 (2021), the application is again considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court.

Bernstein, J., did not participate because he has a family member with an interest that could be affected by the proceeding.
