MEMORANDUM OPINION


On October 25, 2005, we issued an order stating that this appeal is abated because of the filing of a Notice of Bankruptcy by one of the appellants. The parties have filed a Joint Notice of Settlement, Motion to Reinstate, and Motion to Reverse and Remand The Case For Further Proceedings, stating that the parties have fully resolved and settled all issues in dispute. A certified copy of an order lifting the automatic stay is attached to the motion. See Tex.R.App.P. 8.3(a). It is therefore ORDERED that the motion to reinstate is GRANTED. This appeal is reinstated on the docket of this court.

In their joint motion, the parties request that the trial court's judgment be reversed, and that the cause be remanded for the entry of a judgment in conformity with the parties' settlement agreement. The motion is GRANTED. The judgment of the trial court is reversed, and the cause is remanded for the entry of a judgment in conformity with the settlement agreement. Costs of appeal are taxed against the party who incurred them.
