This case was called for a Pretrial Conference and for Trial at the May 8, 2023, Omaha, Nebraska Trial Session of the Court on May 8, 2023, and May 9, 2023.
By Order dated May 11, 2023, docket entry 32, the Court directed the parties, on or before May 30, 2023, to file with the Court additional documents pertaining to this case; and held the record open until further direction of this Division of the Court.
On May 5, 2023, docket entry 26, the parties filed a First Supplemental First Stipulation of Facts. The parties indicated during the trial that Exhibit 30-J contained additional pages that should not be part of the record. On May 22, 2023, docket entry 40, the parties filed a First Supplemental First Stipulation of Facts, with attached Exhibits 5-J - 36-J, which contains the corrected Exhibit 30-J. This document corrects the parties previously filed First Supplemental First Stipulation of Facts, filed May 5, 2023, at docket entry 26. Therefore, the Court will strike the parties previously filed First Supplemental First Stipulation of Facts at docket entry 26 and accept the parties' First Supplemental First Stipulation of Facts, the filing at docket entry 40.
On May 30, 2023, docket entry 42, the parties filed with the Court a Fifth Supplemental Stipulation of Facts consisting of paragraphs 123 through 137, with attached Exhibits 74-J through 88-J.
After due consideration, and for cause, it is
ORDERED that the parties' First Supplemental First Stipulation of Facts, filed May 5, 2023, docket entry 26, is hereby stricken from the Court's record in this case and is replaced by the parties' First Supplemental First Stipulation of Facts, filed May 22, 2023, docket entry 40. It is further
ORDERED that the Exhibits 74-J through 88-J, attached to the parties' Fifth Supplemental Stipulation of Facts, filed May 30, 2023, docket entry 42, are admitted into evidence.
