STIPULATED ORDER SETTING DEPOSITION OF MAURA BREEN AND ESTABLISHING SCHEDULE FOR CONSIDERATION OF MOTION FOR PRELIMINARY INJUNCTION STIPULATION
In accordance with the Court's minute entry dated December 20, 2002, the parties, by their undersigned attorneys, stipulate to the subjoined order that summarizes the Court's rulings on the State Defendants' motion to continue consideration of the Verizon Plaintiffs' motion for a preliminary injunction and to compel limited discovery and establishing a schedule for taking the deposition of Ms. Maura Breen and the consideration of the Verizon plaintiffs motion.
ORDER
This matter came before the Court on the motion of the State defendants for an order compelling discovery and continuing consideration of the motion of the Verizon plaintiffs for a preliminary injunction. The Court considered the memoranda and declarations submitted by the parties, the other pleadings filed in this case, and the foregoing Stipulation of the parties. Based on the above, IT IS HEREBY ORDERED:
1. The motion of the State defendants to compel discovery and to continue consideration of the Verizon plaintiffs' motion for a preliminary injunction is granted in part as follows:
a. The Verizon plaintiffs shall make Ms. Maura Breen available for a deposition by the State defendants on Friday, January 10, 2003, at 8:30 a.m., in Seattle, Washington.
b. The State defendants may file and serve a supplemental brief of no more than 12 pages on or before Friday, January 17, 2003.
c. The Verizon plaintiffs may file a response of no more than 12 pages to the State defendants' supplemental brief on or before Thursday, January 23, 2003.
d. The Court will hold oral argument on the Verizon plaintiffs' motion for a preliminary injunction on Friday, January 31, 2003, at a time and place to be designated by the Clerk.
2. That portion of the State defendants' motion seeking a deposition of a representative of the Verizon plaintiffs pursuant to F.R.C.P. 30(b)(6) is denied.
