On July 18, 2023, we granted the parties' joint motion to abate this appeal for the parties to mediate and reach a settlement. We ordered Appellant to file (1) a motion to reinstate or (2) a joint motion to dismiss this appeal by October 16, 2023.
After the due date, Appellant/Cross-Appellee Olga Lydia Venegas and Appellee-Cross-Appellant Maribel Veronica Ortiz filed a joint motion to extend the abatement. During the abatement, the trial court appointed a receiver to sell certain real property. The property "is arguably the largest valued asset on appeal," and its sale may allow the parties to settle their disputes. The parties ask this court to extend the abatement until the receiver sells the real property.
"It is the policy of this state to encourage the peaceable resolution of disputes . . . [including] through voluntary settlement procedures." Tex. Civ. Prac. & Rem. Code Ann. § 154.002; accord Loya v. Loya, 526 S.W.3d 448, 449 (Tex. 2017).
The parties' motion is granted. See Tex. Civ. Prac. & Rem. Code Ann. § 154.002; Loya, 526 S.W.3d at 449. This appeal remains abated.
We order Appellant to file (1) a motion to reinstate or (2) a motion to dismiss this appeal by January 16, 2024.
All other appellate deadlines remain suspended pending further order of this court.
