This case is calendared for trial at the Court's September 23, 2024, New York City, New York, Trial Session. On August 30, 2024, petitioner filed a Motion to Change Place of Trial to Houston, Texas. Also, on August 30, 2024, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Pursuant to a teleconference with the parties on September 11, 2024, in which the parties agree, the Court will grant petitioner's Motion and deny respondent's Motion. Therefore, it is

ORDERED that this case is continued generally and stricken for trial from the trial session scheduled to commence on September 23, 2024, at 10:00 A.M., at the Alexander Hamilton U.S. Custom House, One Bowling Green, Courtroom 610, 6th Floor, New York, New York 10004. It is further

ORDERED that petitioner's Motion to Change Place of Trial is granted, in that the place of trial is changed from New York City, New York, to Houston, Texas. It is further

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute is denied.

This Order constitutes official notice of its contents to the parties.
