The Court has been advised that the parties have jointly stipulated to dismiss Capital One Bank (USA), N.A, without prejudice. See Dkt. 40. All parties have now been dismissed. See Dkts. 34, 36, 38. Therefore, the Court dismisses this matter in its entirey, with each of the parties to bear their own fees and costs.
