ORDER GRANTING SUMMARY JUDGMENT


On July 18, 2005, at 2:00 p.m., Defendants Utah County, Utah County Sheriff's Department, James Tracy, Grant Ferre, Jason Phillippi, and Todd Orton's ("the Utah County Defendants") Motion for Summary Judgment came on regularly for hearing before The Honorable Bruce S. Jenkins. Mark D. Stubbs, Esq., and Trent M. Sutton, Esq., appeared on behalf of Plaintiff. Peter Stirba, Esq., appeared on behalf of the Utah County Defendants.

Upon consideration of the Motions, Memoranda and oral arguments submitted by the parties, and for good cause appearing, the Court hereby ORDERS as follows:

1. The Utah County Defendants' Motion for Summary Judgment is GRANTED; and

2. Plaintiff's First, Second, and Third Claims for Relief by the same are hereby DISMISSED with prejudice as to the Utah County Defendants.
