MEMORANDUM/ORDER


On January 31, 2005, plaintiff Dhanniell Aquino Vega, Sr. filed a motion to proceed in forma pauperis. On March 18, 2005, Mr. Vega's petition was denied without prejudice, and he was accorded twenty days to file a notice that he wished to pay the $250 filing fee and proceed with his case. On March 29, 2005, Mr. Vega filed a motion requesting permission to withdraw the case temporarily, pending his release from prison. In light of this court's order of March 18 denying Mr. Vega's petition without prejudice, this motion (docket #7) is DENIED as MOOT; in the future, Mr. Vega may refile this case if he so chooses.
