Opinion

Case No. SC05-168.

June 8, 2006.

Lower Tribunal No. 04-10975-HH.

In Vector Products, Inc. v. Hartford Fire Ins. Co., 397 F.3d 1316, 1318 (11th Cir. 2005), the United States Court of Appeals for the Eleventh Circuit certified a question as determinative of a cause pending in that court for which there appeared to be no controlling precedent. On May 15, 2006, that court issued an order dismissing with prejudice the underlying appeal which was the subject of the certified question. Appellant has filed a notice of settlement and dismissal pursuant to Florida Rule of Appellate Procedure 9.350(b) in this Court. Accordingly, the question certified to this Court by the United States Court of Appeals for the Eleventh Circuit is hereby dismissed.

PARIENTE, C.J., and WELLS, ANSTEAD, LEWIS, QUINCE, CANTERO and BELL, JJ., concur.
