DECISION AND ORDER ON MOTION

Motion for extension of time to perfect appeal taken by appellant-respondent and for permission to file and serve oversized brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion for an extension of time to perfect the appeal taken by appellant- respondent is denied, without costs, on the ground that the motion papers fail to set forth facts showing merit to the appeal as required by section 800.12 of this Court's Rules of Practice, and it is further

ORDERED that the motion to file and serve an oversized brief is denied, without costs, and without prejudice to renewal upon obtaining an extension of time to perfect the appeal.
