ORDER


With respect to the discovery issues raised by counsels' letters of October 7 and 9, 2002:

1. Plaintiff shall appear for and submit to a second day of examination.

2. Defendant may subpoena Travel Holiday. This ruling does not predetermine any objection that Travel Holiday may interpose to the subpoena.

3. Defendant's objection to Interrogatory No. 10 are overruled.

4. Defendant's objection to Document Request No. 9, to the extent it seeks documents that are or contain complaints filed with the EEOC, the New York State Division of Human Rights, and/or the New York City Human Rights Commission of alleged age discrimination, is overruled. It is sustained in all other respects.

5. Defendant's objection to the production of documents relating to the job performance of persons in the Merchandising Department, to the extent it has not been withdrawn as indicated in counsel's letter dated October 9, 2002, is sustained.

SO ORDERED.
