Elias Esequiel VASQUEZ, Appellant v. THE STATE OF TEXAS, Appellee

From the 229th Judicial District Court, Starr County, Texas

Trial Court No. 11-CRS-270

Honorable Ana Lisa Garza, Judge Presiding

ORDER

Sentence was imposed on May 3, 2013 and appellant filed her notice of appeal on May 29, 2013. The records were therefore due on September 3, 2013. See TEX. R. APP. P. 35.2(a). On September 5, 2013, we notified both the trial court clerk and the court reporter that the records were late. The trial court clerk filed a notice of late record, stating that the appellant has failed to pay or make arrangements to pay the fee for preparing the clerk's record. See TEX. R. APP. P. 35.3(a), (b).

It is therefore ORDERED that appellant provide written proof to this court within ten days of the date of this order that either: (1) the fee for preparing the clerk's record has been paid or arrangements have been made to pay the fee; or (2) appellant is entitled to appeal without paying the fee. See id.
